Interpretation and Definitions
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Philomatech UG (haftungsbeschränkt) in Riedlingen.

Website refers to Omes, accessible from omes.app
Service refers to the Website and the App Omes.
Country refers to: Baden-Württemberg, Germany

It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.
Personal Data is any information that relates to an identified or identifiable individual.
Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

Usage Data is collected automatically when using the Service.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data. We only store Your IP Address to create a basis for legal action in case of abuse. We do not track you based on your IP Address or use it in any other way.
We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.
While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to.:

Use of Your Personal Data
To provide You with our service, we need Your personal data. It is important to us that You understand how, when and why we use Your data.
During Log-In Process:
Your Email-Address: During registration we need Your email address to identify You. If You do not want to register with a service like Google or Microsoft, we will also need to send You an email to verify Your identity. This is the only way we can be sure that it is Your own email address and that You really are You.
Your Password: To protect Your account, we provide Your account with a password unless You choose to register using Google or Microsoft. Your password is not stored in clear text, so even in the unlikely event of a hacker attack, it is still safe
Your Name: To make Yourself recognizable to other users we need Your name. Other users can see Your name and write to You.
Your Profile Image: If You register with us via a service such as Google or Microsoft, we will take Your profile picture if You have one stored with that service. This saves You time and You can start right away without having to edit Your profile. When other users search for Your name, it will be displayed together with this picture. You can change or delete Your picture at any time.
Your Messaging Token: To let You know if someone has contacted You via our app or if there is any other information we want to share with You, we need to send You notifications like You know from WhatsApp or other messengers. It would be a pity if someone invited You for Your birthday without You knowing about it. Therefore, we need the messaging token to know where to send the notification. During registration, we save Your messaging token in Your database.
During usage of our app:
Your Email-Address: Like during the registration process, we need Your email address to identify You.
Your Name: To make Yourself recognizable to other users we need Your name. Other users can see Your name and write to You. Your name will be shown inside a group if You are a member of it.
Your Profile Image: When other users search for Your name, it will be displayed together with this picture. Also the image will be shown inside the member list of the groups You are a member in and various other places. You can change or delete Your picture at any time.
Your personal description: You can add a description to Your profile. This description is displayed to other users in combination with Your name and Your profile image. That is also the case in various other occasions, for example if an other user visits Your profile page.
Your Messaging Token: To let You know if someone has contacted You via our app or if there is any other information we want to share with You, we need to send You notifications like You know from WhatsApp or other messengers. It would be a pity if someone invited You for Your birthday without You knowing about it. Therefore, we need the messaging token to know where to send the notification.
Retention of Your Personal Data
Transfer of Your Personal Data
Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.
Disclosure of Your Personal Data
Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).
